Terms of Service

These terms apply when you use the Learn Punjabi by PunjabiCharm mobile app or the punjabicharm.com website (together, the “Service”), operated by PunjabiCharm (“we”, “us”, “our”). By using the Service you agree to them and to our Privacy Policy. If you do not agree, please do not use the Service.
Who can use it
You must be 18 or over to use the Service or create an account. The app is rated for an audience of 18 and over, and by using it you confirm that you meet that requirement.
Many of our learners use PunjabiCharm to teach Punjabi to their children. That is what it is for — but the account holder must be an adult, the account and any subscription remain theirs, and they are responsible for how their child uses it, including any purchases made on their device.
Your account
An account is optional — the app works without one. If you create one, you do so by signing in with Google or Apple, and you are responsible for keeping access to that account secure. Tell us promptly if you believe someone else is using it.
You may delete your account at any time, in the app or by asking us. See Delete your account.
Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own learning and for teaching your own family. That licence lasts as long as you comply with these terms.
You may not:
- copy, sell, rent, sub-licence or redistribute the app or its content;
- use our lessons, audio or artwork in your own product, course or channel;
- reverse-engineer or attempt to extract the source code or audio library, except where law expressly permits it;
- use the Service unlawfully, interfere with its operation or security, or attempt to access other users' data;
- use automated means to scrape or bulk-download content.
Subscriptions and billing
The app is free to use, with some lessons, stories and games reserved for subscribers. Subscriptions are auto-renewing: unless you cancel, they renew at the end of each period and you are charged again.
All payments are handled by Google Play or the App Store, not by us. The price, currency, billing period and renewal date are shown to you before you buy and are charged to your store account. We never see or store your card details.
If we change subscription prices, the change applies only to future billing periods, and the stores will notify you and seek your agreement where their rules require it. You can always cancel before the change takes effect.
Cancelling and refunds
Cancel any time from your store account — cancelling stops the next renewal and you keep access until the end of the period you have paid for:
Refunds are issued by the store you bought through, under that store's refund policy — we cannot process them for you, though we will help you deal with the store if something has gone wrong. Deleting your account does not cancel a subscription.
If you are in the UK or the EEA you may have a statutory right to cancel a purchase within 14 days. That right exists alongside the store's policy, and nothing here removes it.
Your rights as a consumer are not affected
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under consumer law that cannot be excluded by agreement. In particular:
- Australia — our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be provided with due care and skill. For a major failure you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss.
- New Zealand — the Consumer Guarantees Act 1993 applies where you acquire the Service as a consumer, and nothing here limits it.
- United Kingdom — your rights under the Consumer Rights Act 2015 apply, including that digital content must be of satisfactory quality and as described.
- Canada and elsewhere — your local consumer protection law applies where it cannot be contracted out of.
Advertising
The free version of the app shows ads. Subscribing removes them. How advertising works, and the choices you have over it, are set out in our Privacy Policy.
Our content
The Service and everything in it — lessons, audio recordings, artwork, text, the PunjabiCharm name and brand — belongs to us or is licensed to us, and is protected by copyright and trade mark law. Your licence above does not transfer any ownership to you.
The learning material is provided for general education. We work hard to make it accurate, but language teaching involves judgement, regional variation and simplification, and we do not warrant that every item is complete or error-free.
Feedback
If you send us ideas or suggestions, we may use them to improve the Service without obligation or payment to you. Please do not send us anything you consider confidential or wish to be paid for. You keep ownership of anything you send; you are simply giving us permission to act on it.
Availability and changes
We may add, change, or withdraw features, lessons or content, and we may suspend the Service for maintenance. If we withdraw something you are currently paying for and cannot offer a reasonable equivalent, you may cancel and seek a refund of the unused portion through your store.
We may suspend or terminate your access if you materially breach these terms — for example by redistributing our content or attempting to compromise the Service. Where it is reasonable to do so, we will warn you first.
Disclaimers and liability
Except for the consumer rights described above and anything else that cannot lawfully be excluded, the Service is provided “as is”. We do not promise it will be uninterrupted or error-free, or that it will produce any particular level of language ability.
To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you for any claim connected to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or CAD $50. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
App store terms
These terms are between you and PunjabiCharm only — not with Apple or Google. Apple and Google are not responsible for the app or its content, and have no obligation to provide support or maintenance for it. If the app fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price of the app itself; beyond that, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also comply with the terms of the store you downloaded it from.
Changes to these terms
We may update these terms. The date at the top shows the latest revision, and we will bring material changes to your attention in the app or by email before they take effect. Continuing to use the Service after that means you accept the revised terms; if you do not, you can stop using the Service and cancel any subscription.
Governing law
These terms are governed by the laws of Canada. Wherever you live, you keep the benefit of any mandatory consumer protection law of your own country, and you may bring proceedings there if that law gives you the right.
General
If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. These terms, with our Privacy Policy, are the entire agreement between us about the Service.
